You may need a Do Not Call (DNC) policy if your company makes phone calls or sends texts to consumers for any marketing purpose. The TCPA and TSR, and some state laws, require that a company that calls or sends text messages for the purpose of marketing to consumers must have a written policy in place in order to comply with DNC regulations.
A well-written DNC policy explains how you will maintain a do not call list and outlines the process you will use to accept and honor do not call requests made to you. Maintaining a written DNC policy and making it available if requested by a consumer are key components to meeting federal and state legal obligations under the TCPA and TSR.
A DNC policy should include procedures for the following:
- Recording DNC requests with the consumer’s name and telephone number;
- Honoring the request within a reasonable time;
- Suppressing numbers on a company-specific or internal DNC list;
- Scrubbing numbers against the national and any relevant state DNC lists;
- Correctly using established business relationship exemptions;
- Training personnel engaged in telemarketing in the existence and use of policy;
Some organizations may be exempt from this requirement.
